CLUTCHGRAB POLICIES
Terms of Use
These Terms govern participation in the ClutchGrab invite-only U.S. pilot. By accepting them, you agree to follow these rules.
Eligibility and accounts
You must be at least 18 years old, use accurate account information, keep your credentials secure, and be admitted through the current invitation process. Invitations are personal unless ClutchGrab expressly designates them for multiple users. You are responsible for activity under your account and must promptly report suspected unauthorized access.
ClutchGrab’s role
ClutchGrab provides classifieds, messaging, and safety-reporting tools. ClutchGrab is not the buyer, seller, owner, dealer, broker, payment processor, escrow provider, shipper, inspector, authenticator, or guarantor of an item or transaction. Members decide whether to transact and arrange payment, pickup, shipping, returns, and disputes directly with each other.
Seller responsibilities
Sellers must own or be authorized to sell each item; provide truthful, complete descriptions and current photos; disclose known wear, damage, impacts, missing parts, modifications, and compatibility limitations; and comply with applicable law. Sellers must check relevant government and manufacturer recall information before listing. Recalled, counterfeit, stolen, unlawful, or known-unsafe items may not be offered.
Buyer responsibilities
Buyers must independently evaluate identity, ownership, authenticity, condition, recalls, fit, compatibility, payment, pickup, and shipping. Listing checks and moderation do not constitute inspection, approval, or certification. Review the item and manufacturer guidance before purchase or use and follow the Marketplace Safety rules.
Helmets and protective equipment
Used helmets and protective equipment can have hidden damage. Helmet certification and condition information is seller-reported. ClutchGrab does not physically inspect, test, authenticate, approve, or certify gear. A listing’s presence or an administrator spot-check is not a safety determination. Known-crashed, visibly cracked, structurally modified, over-age under ClutchGrab’s policy, or otherwise ineligible helmets are prohibited.
Member conduct
Do not engage in fraud, harassment, threats, discrimination, impersonation, spam, illegal activity, credential sharing, scraping, security interference, or attempts to bypass invitations, restrictions, or moderation. Do not post another person’s private information or content you lack permission to use.
Your content
You retain ownership of your listing content. You grant ClutchGrab a non-exclusive, worldwide, royalty-free license to host, process, reproduce, display, and format that content only as needed to operate, secure, moderate, and promote the marketplace. You represent that you have the rights needed to provide it.
Moderation and pilot availability
ClutchGrab may review reports, preserve evidence, limit visibility, remove content, restrict accounts, or end the pilot when reasonably necessary for safety, integrity, legal compliance, or service operation. Available appeal tools remain subject to the stated retention and review procedures. We do not promise uninterrupted or error-free service.
No warranties
To the extent permitted by law, the service is provided “as is” and “as available.” ClutchGrab disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.
Limits of responsibility
To the extent permitted by law, ClutchGrab is not responsible for indirect, incidental, special, consequential, or punitive damages; loss of data or opportunity; or injuries, losses, and disputes arising from member conduct, listed products, or transactions arranged between members. These limits do not apply where prohibited by law.
Changes and contact
